A defendant shall be punished by imprisonment for six months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

[2014 Highest 4525] The defendant is a representative director of (ju) Dogdong Group C, who is an employer who operates a rice processing machine manufacturing company using 14 regular workers.

When a worker retires, the employer shall pay the wages, compensations, and other money, valuables, and retirement allowances within 14 days after the cause for such payment occurred.

The Defendant is working in the above workplace from January 2, 2014 to April 12, 2014.

The wages and other allowances of retired workers E, including KRW 20,513,180, did not pay the total of KRW 46,428,790, including four workers, within 14 days from the date of retirement, as described in the separate list of crimes (1) Nos. 1, 2, 3, and 4.

[2014 Highest 4994] The defendant is a representative director of (ju) D in Gyeongbuk-gun, who operates a rice processing machine manufacturing company using 14 regular workers.

When a worker retires, the employer shall pay the wages, compensations, and other money, valuables, and retirement allowances within 14 days after the cause for such payment occurred.

The Defendant shall work in the workplace from July 15, 2014 to July 31, 2014.

As shown in the table Nos. 2 and 3 of the attached Table 2 and 3, as well as wages of 1,820,000 won of retired workers F, the total amount of wages of 3,640,000 won was not paid within 14 days from the date of retirement without an agreement on the extension of the date.
