A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2018 Highest 2020"

1. The Defendant is the representative director of E Co., Ltd. in Kimhae-si F, who runs automobile parts manufacturing business using 60 full-time workers.

From July 17, 2017 to April 4, 2018, the Defendant did not pay the total amount of KRW 9,279,006 of the wages and retirement allowances of G workers employed in production at the aforementioned workplace within 14 days from the date of retirement without agreement between the parties on the extension of the due date, as shown in attached Table 1, including that the Defendant did not pay the total of KRW 12 of the wages and retirement allowances of 80,984,239 within 14 days from the date of retirement without agreement between the parties on the extension of the due date.

2. The Defendant, as the representative director of H Co., Ltd., Ltd., which is in Kimhae-si I, is an employer who conducts automobile parts manufacturing business using 65 full-time workers.

From March 2, 2010 to March 16, 2018, the Defendant appears to have paid 37,874,290 won in total as wages and retirement allowances of 69,581,750 won in total for 69,383,750 won in the facts charged, as shown in attached Table 2, including that the Defendant did not pay 37,874,290 won in total as wages and retirement allowances of 69,581,750 won in total for 69,581,780 won in the facts charged, without any agreement between the parties on the extension of the date.

The payment was not made within 14 days from the date of retirement without agreement on the extension of the period between the parties.

The defendant of "2018 Highest 2552" is the representative of H in Kimhae-si I and the representative of H in K in Kimhae-si, who ordinarily employs 24 full-time workers and operates the business of manufacturing motor vehicle parts.

In addition, the Defendant did not pay KRW 2,673,150 as wages and retirement allowance 21,346,184 as wages on March 2, 2018, as well as KRW 21,346,184 as wages of workers L, who worked at H during the period from April 2, 2010 to April 21, 2018, within 14 days from the date of retirement without an agreement between the parties on the extension of the period.
