1. 피고인들은 공모하여 2018. 1. 7.경 서울 성북구 D에 있는 E편의점 앞에서, 사실은 피해자가 피고인들의 주택을 빼앗은 사실이 없고 피고인 B의 부친 F의 장례비용을 편취한 사실이 없음에도 ‘돈에 미친 인간’이라는 제목으로 ①“고 G 치과의사 부인 C 사촌조카 집 뺏고 겁탈하고 버렸다”, ②“할아버지 할머니 장례비 사기치고 아버지까지”, ③“돈에 미치고, 돈에 환장한 어린 조카에게 몹쓸 짓하고 너는 인간이 아니라 짐승이다 C”이라는 허위 사실을 적시한 피켓을 작성한 후, 피고인 B은 위 피켓을 들고 여러 사람들이 왕래하는 노상에서 1인 시위를 하고, 피고인 A은 시위 현장 주위에서 지켜봄으로써 공연히 피해자의 명예를 훼손하였다.
