Reasons
1. Basic facts
A. The Plaintiff is a party. 1) The Plaintiff is a A apartment located in Songpa-gu Seoul Metropolitan Government (hereinafter “instant apartment”).
2) Defendant Hyundai Industrial Development Co., Ltd. (hereinafter “Defendant Hyundai Industrial Development Co., Ltd.”) is a project proprietor who constructed and sold the instant apartment, and around March 2005, the Defendant Hyundai Industrial Development Co., Ltd. (hereinafter “Defendant Co., Ltd”) is a company that constructed and sold the instant apartment from the Defendant Co., Ltd. under a contract with the Defendant Co., Ltd. for construction works on the 17-dong and 296 households among the 72-dong and 5,678 households of the instant apartment.
3) Defendant Housing and Urban Guarantee Corporation (the Korea Housing and Housing Guarantee Corporation prior to the alteration; hereinafter “Guarantee Corporation”).
(B) On October 27, 2008, the Defendant Company entered into each of the instant warranty contracts (hereinafter “each of the instant warranty contracts”) with the head of Songpa-gu Office, with the guarantee creditor as the head of Songpa-gu Office, on the part of the instant apartment units on behalf of the Defendant Company. (B) On October 27, 2008, the Defendant Company entered into each of the instant warranty contracts (hereinafter “each of the instant warranty contracts”) as indicated below, and the Defendant Guarantee Company issued each of the respective warranty guarantees under each of the instant respective warranty contracts.
