1. The judgment of the first instance, including the Plaintiff (Counterclaim Defendant)’s principal claim expanded from the trial, is as follows:
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The status of the Plaintiff is a school foundation operating A University; the Plaintiff was changed from Defendant L to Mro Co., Ltd. on December 2, 2009; and as of May 20, 2010, in sequence, from May 20, 2010. The purpose of the Plaintiff is to fish education service for foreigners in Korea and foreigners, as well as to arrange study abroad.
(b) Operation of C Program;
1. Under the cooperation with the Plaintiff, the Defendant recruited applicants for programs C for each State university of this case, sent the support documents to each State university of this case. Each State university of this case shall determine whether to grant the relevant applicants’ admission.
2. In order to improve students’ academic ability to take part in the study, the Defendant provided a ACLP, an English intensive training curriculum, at the Plaintiff’s facility, to enable a person who has obtained permission to enter each of the instant main colleges, to take 30 credits (45 credits in quota programs) from A University by attending an international visit and exchange course for one year at A University.
3. Each State university of this case recognizes credits obtained by a person who has obtained the approval for admission to the said C Programs as credits earned at A University.
