1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff is a person who was an employee of a company that was engaged in manufacturing medical devices and wholesale and retail business, and the Defendant is a company of the United States of America that engages in selling medical devices.

B. A sales contract between C and the Defendant is a name used in the transaction with D or E when engaging in the wholesale and retail business of medical devices from around 1988. C has been engaged in a transaction by using the trade name called “D” or “E.” From January 31, 2010. C has an exclusive right to marketing, sale, and distribution in the Republic of Korea of the Defendant’s products by December 31, 2014, and under the terms and conditions of the contract, the Plaintiff shall pay the price for the products supplied by the Defendant to the Plaintiff under the terms and conditions of the contract.

2) As to the governing law and jurisdiction in the instant total sales contract, the following is determined:

10.The governing law of the general clause (a) and the governing general contract of this case shall be governed and interpreted in accordance with the laws of California.

The federal and state courts in California shall have exclusive jurisdiction over the judicial settlement of disputes arising out of the instant sales contract.

“E. The same shall apply hereinafter.” (i) the personnel jurisdiction of the federal and state courts in California, (ii) the procedure of delivery by means of a registered mail sent to the address described in the book stated in the book of the instant entire contract is valid, and (iii) the express consent is given to enforcement without objection to the above final judgment of the court in any other jurisdiction where the property is present.
