Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

On September 7, 2016, the Defendant was released on November 30, 2017, when he/she was sentenced to imprisonment for a violation of the Military Service Act, with one year and six months as a result of the violation of the Military Service Act, and the remaining term of imprisonment has expired on March 19, 2018.

The Defendant is a person who registered his/her business with the trade name “BF” around August 20, 2018 and conducts business such as assembly, sale, business trip, repair, etc. of computers.

On March 28, 2019, the Defendant posted a letter “I will sell assembly PCs or computer parts” to BI website “BJ,” using a computer at BI website “BJ,” and the Defendant makes a false statement to the victim BA who reported and contacted the above letter at around 16:10 on the same day.”

However, the Defendant had no intention or ability to send computer parts to the victim BA even if he/she received the payment from the victim BA, because the other customer had thought that he/she would purchase or use the computer parts ordered by the other customer as the cost of living.

Nevertheless, at around 16:30 on the same day from the victim BA, the Defendant received 674,000 won in total from the victims to the BK account (BL) in the name of the Defendant used by the Defendant, as the price for computer parts, and received 65,714,700 won in total from April 17, 2019 to October 10, 2019 in the same manner as shown in the attached Table 1.

Accordingly, the defendant deceivings the victims.
