A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. A violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Aggravated Punishment, etc. of Specific Crimes) and a violation of the Road Traffic Act (hereinafter referred to as the "Act") were driven by a Dok-in car on January 8, 2015, and the Defendant was driving a Dok-in car on the street in front of Geumcheon-gu Seoul, Geumcheon-gu, Seoul, while neglecting his/her duty at the front time, caused the collision with the front part of the car that the Defendant driven by the victim F.(54 years old) who was a traffic signal at the front of the Defendant’s driving direction.
Ultimately, the Defendant by occupational negligence inflicted injury on the victim, such as salt, tensions, etc. in need of medical treatment for about 10 days, and at the same time, did not stop immediately to the extent of 2,344,800 won repair cost, and escaped without taking necessary measures, such as providing relief to the victim.
2. The Defendant violated the Road Traffic Act (unlicensed Driving) around the time specified in paragraph (1) of this Article, driving a vehicle with the highest driver’s license in the section of about 5 km from the Silung-dong, Geumcheon-gu to the front road of Geumcheon-gu Seoul Metropolitan Government without obtaining a driver’s license.
3. Any person who violates the Motor Vehicle Management Act shall, when he/she takes over a registered motor vehicle, file an application for registration of transfer of ownership with the Mayor/Do Governor as prescribed by
Nevertheless, the Defendant purchased at least 3.5 million won of a passenger car with the highest price specified in paragraph (1) from a person with no name but to acquire it, but did not apply for the registration of transfer of ownership of the said passenger car within 15 days without justifiable grounds.
4. No person who violates the Guarantee of Automobile Accident Compensation Act shall operate any automobile on a road which is not covered by mandatory insurance;
Nevertheless, the Defendant is Geumcheon-gu Seoul at the same time as paragraph (1).
