A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
C: (a) On January 2012, 2012, C asked D, who was known to the police officer in Franchising, to “I would be able to ask for a counterfeited check, so that I would be able to purchase it.” (b) At that time, D would be able to purchase F through E, which was known to the ordinary world on June 2012 at the end of Franchising, by stating that “I would have been able to suspend payment of KRW 1 billion” to F, and F would have accepted it around that time.
In addition, C asked G, which was known to the police officer in the middle of January 2012, 201, to request that “10 million won counterfeited checks be asked.” Accordingly, G was issued 100 million won cashier’s checks issued at a forged bank (hereinafter “100 cashier’s checks of this case”) by requesting H to the same purport on June 2012, upon requesting H to the same purport. At that time, the Defendant requested H to the same purport, and issued 10 million won cashier’s checks issued at a forged bank (hereinafter “10 cashier’s checks of this case”).
After that, around 19:00 on June 16, 2012, G and the Defendant issued C with G for the purpose of distributing 100 copies of the forged cashier’s checks of this case to others at the Posco building underground Posco building near the Guro-gu Seoul Metropolitan Government Posco Station.
After that, at around 13:45 on June 17, 2012, C was trying to look at F at the YY apartment apartment park located in Busan Soksan-dong, or to deliver 100 copies of the falsified cashier’s checks of this case to F. Around that time, F, who was suspected of being forged, filed a report to F, was arrested by a police officer who was temporarily temporarily locked in the above small park and seized 100 copies of the falsified cashier’s checks of this case.
As a result, the Defendant conspired with C, G, D, etc. in sequence, and C, G, and D were convicted on October 23, 2012 as a co-principal of the crime committed in Busan District Court on March 5, 2013.
