1. The defendant has each of the following points: 1, 2, 3, 4 and 1, indicated in the attached drawings on the ground of 67m2 in Gwangju Northern District, Gwangju Northern District.
Reasons
1. Facts of recognition;
A. Gwangju Metropolitan City, as a part of the Gwangju Metropolitan City urban planning facility project, has carried out access roads and public land creation projects to the Gwangju Northern-gu D, and the project implementer selected the Plaintiff.
B. The Plaintiff consulted with the owner, etc. to acquire the land, etc. incorporated into the above development project after obtaining the designation of the project implementer and the authorization of the implementation plan for the above development project and publicly notified the designation of the project. [The Plaintiff agreed with the owner, etc. to acquire the land, etc. incorporated into the development project, but did not reach an agreement on the amount of compensation, the Plaintiff, as the project implementer, filed an application for adjudication for the expropriation with the Gwangju Regional Land Tribunal.
C. On August 5, 2016, Gwangju Regional Land Tribunal accepted 67m2 (hereinafter “instant land”) of the Plaintiff’s miscellaneous land owned by the Plaintiff, and decided to compensate the Plaintiff for losses at KRW 126,017,650.
The defendant was served on August 11, 2016 of the above written ruling.
The Plaintiff deposited the above compensation for losses with the Defendant as the depositee, and completed the registration of ownership transfer on September 6, 2016 for the instant land based on expropriation on September 4, 2016.
E. On August 29, 2016, the Defendant refused the Plaintiff’s receipt of the said deposit and filed an objection with the Central Land Expropriation Committee.
