A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From January 2017 to June 13, 2017, the Defendant kept forged goods, etc. in a warehouse located in the third floor parking lot of Dongdaemun-gu Seoul Metropolitan Government apartment complex C, and sold the goods at the street log in Seoul Jung-gu.

1. 상표법위반 피고인은 2017. 6. 13. 경 위 창고에서 상표권 자인 프랑스 ‘루 이비 똥 말 레 띠에’ 사, ‘ 샤넬’ 사, ‘ 이브 생 로랑’ 사, ‘ 해 르 메스 앵 떼 르나 시 오 날’ 사, 이탈리아 ‘ 구치 오구치 쏘시에 떼 퍼 아 찌 오니’ 사, ‘ 보 테가 베네 타 인터 내셔널. 에스. 에이. 알. 엘’ 사, 룩 셈 부르크 ‘ 프라다 에스. 에이’ 사, 스위스 ‘ 발리 슈 허 파브리 켄 아크 티엔 게젤샤프트’ 사, 독일 ‘ 몬트 부란 크심푸로 게 엠 베 하’ 사, 영국 ‘ 버버리 리 미 티드’ 사가 각 대한민국 특허청에 그 지정상품을 가방, 지갑 등으로 정하여 등록한 ‘루 이비 똥 (LOUIS VUITTON)', ' 샤넬 (CHANEL)', ‘ 입 생로랑 (YVESSAINTLAURENT)’, ‘에 르 메스 (HERMES)', ' 구치 (GUCCI)', ’ 보 테가 베네 타 (BOTTEGA VENETA)', ' 프라다 (PRADA)', ’ 발리 (BALLY)‘, 몽블랑 (MONTBLANC)', ' 버버리 (BURBERRY)' 와 각 동일 유사한 상표가 부착표시된 별지 목록 기재와 같은 가방, 지갑, 휴대폰 케이스, 라이터, 스카프 등 합계 2,014점( 정품 추정 시가 합계 42억 6,017만원 상당) 을 판매하기 위해 소지함으로써 상표권 자들의 상표권을 각 침해하였다.

2. A person who intends to operate a retail business of tobacco in violation of the tobacco business shall obtain a designation as a retailer from the head of the Si/Gun/Gu having jurisdiction over the location of the place of business, and no person other than a retailer shall sell tobacco to consumers.
