1. Defendant A shall be punished by imprisonment for six months.

2. Defendant B shall be punished by a fine of KRW 3,00,000.

Punishment of the crime

1. Defendants’ conspiracy to commit a crime

A. The fraud of Defendant A is a person operating a F Child Care Center from July 8, 2005 to Busan Dong-gu E, and Defendant B is a person holding a Grade II child care teacher qualification.

On July 1, 2009, A submitted a document stating that the employee in charge was appointed as F Child Care Teachers(Grade II) of F Child Care Care Teachers(Grade II) on July 1, 2009 at the victim's Dong-gu Office located in 55, Ma-ro, 94, Ma-ro, Busan, Dong-gu, Busan.

However, in fact, Defendant B lent the name of a child care teacher to Defendant A without any intention to work as a child care teacher, and Defendant B did not actually have been working as a child care teacher at the above child care center.

On July 24, 2009, the Defendants conspired to induce the victim as above and received 80,000 won from the victim to the post office account (G) in the name of the defendant B as the improvement expenses for the treatment of the defendant B, and acquired 12,460,000 won in total from July 27, 2010 to July 27, 2010 as shown in the attached crime sight table (1).

(b) No person who violates the Infant Care Act in connection with the illegal receipt of wages for infant care teachers shall receive any subsidy or use any subsidy by fraud or other improper means;

Nevertheless, the Defendants, in collusion, received a total of KRW 12,460,000 in terms of childcare fees and treatment improvement expenses for the above B in the same manner and at the same time and place as referred to in paragraph (1), and received subsidies in a false manner.

2. The sole crime committed by Defendant A;

(a) No person who has unlawfully appropriated a subsidy for personnel expenses of part-time infant care teachers shall receive any subsidy or use any subsidy by fraud or other improper means;
