Reasons
Punishment of the crime
1. On October 5, 2017, the Defendant was driving a C Poter truck without obtaining a driver’s license in the state of alcohol concentration of about 0.082% from a 100-1-lane from the front side of the 10-1 parking lot in Yangsan-si to the front side of the Busan National University Hospital to the road in front of the Busan National University Hospital.
2. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number;
The Defendant, at the time and place specified in paragraph (1) of the facts charged, controlled drinking driving at a place, and provided a police officer’s resident registration number to obtain a request for personal information from D and used another person’s resident registration number unlawfully.
3. The Defendant: (a) prepared a report on the detection of a drinking driver to the above E using a portable information device (PDA) at the time, at a place specified in paragraph (1) of the facts charged; and (b) demanded the Defendant to sign the report; (c) ordered the above driver’s column, which is an electronic record pertaining to the proof of the fact; and (d) ordered the police officer to transmit the electronic records to the police officer via the internal computer network as if the electronic records were duly established.
In this respect, for the purpose of making administrative affairs excessive, the defendant neglected the driver of the inquiry about the result of drinking control against E, an electronic record of others' proof of facts, and exercised it.
4. The Defendant, at the time and place specified in paragraph (1) of the facts charged, demanded the police officer F to sign a statement report on the situation of the driver working at the police station at the time and place of the instant investigation document, “the principal confirms that the above stated facts are true, and the license is granted due to driving at driving at the bar.
