A defendant shall be punished by imprisonment for a term of one year and eight months.

Punishment of the crime

1. On April 6, 2018, the criminal defendant against the victim B made a false statement to the effect that “The Defendant shall pay to the victim money at an early time on a deposit basis with the victim at an auction by telephone.”

However, even if the defendant borrowed money from the victim, he did not have any intention or ability to repay the personal debt or to use it as the Internet gambling fund.

Around April 6, 2018, the Defendant, by deceiving the victim as such, received from the victim a transfer of KRW 7 million to the new bank account under one’s own name, and around May 14, 2019, KRW 32 million to the same account.

2. On September 16, 2018, the criminal defendant against the victim C made a false statement to the effect that “The defendant would repay the victim a down payment to the victim at an early stage with money borrowed from the phone.”

However, even if the defendant borrowed money from the victim, he did not have any intention or ability to repay the personal debt or to use it as the Internet gambling fund.

Around September 17, 2018, the Defendant, by deceiving the victim, received from the victim a total of KRW 69 million from the same account to the new bank account in his/her name on or around November 13, 2018, KRW 20 million to the same account on or around the same month, KRW 20 million to the same account on or around the 30th day of the same month, and KRW 9 million to the same account on or around August 5, 2019.

3. Around April 14, 2019, the criminal defendant against the victim D made a false statement to the effect that “The victim shall sell a restaurant operated by Aberter, but may sell a restaurant to be paid for the unpaid goods. It may be sold within two weeks from the loan of the proceeds.”

However, it is true.
