Reasons
Punishment of the crime
1. Fraud against the victim B;
A. On December 6, 2017, the Defendant made a false statement stating that “D” operated by the Victim B in Hongsung-gun, Hongsung-gun, the Defendant would pay the Plaintiff, pay the Plaintiff’s tuition fees, and need money to operate the Dindo. The Defendant would also make a false statement to “D.”
However, the Defendant, while there was no particular property at the time, did not have any obligation equivalent to KRW 30,00,000,000 from the lending company, and the bonds were repaid in the way of a 'number of days' by the word "number of days" each day. Since, after having joined several accounts, the Defendant was limited to either repayment of his/her personal obligation or payment of his/her personal obligation in another account, there was no intention or ability to pay his/her obligation even if he/she borrowed money from the victim.
Ultimately, the Defendant, as above, by deceiving the victim, received KRW 3,300,000 on the same day from the victim, and obtained KRW 20,539,100 in total from around that time to April 25, 2018 by the same method as indicated in the separate crime list, and acquired KRW 20,539,100 in total from the victim eight times in total.
B. On January 2018, the Defendant made a false statement that “The Defendant would faithfully pay the 30 million Won to the victim, who is the subject of the rupture of the rupture of 30 million won.”
However, the Defendant, while there was no particular property at the time, did not have any obligation equivalent to KRW 30,000,000,000 from the lending company, and the bonds were repaid in the way of a 'number of days' by the word "number of days" each day. Since the Defendant was transferred to several accounts and received, the Defendant limited the amount of personal debt by the means of a 'reshion', either repayment of the personal debt or payment of the deposit in another account, and thus, he was admitted to the fraternity by the victim.
