Defendant
A shall be punished by imprisonment of one year and two months, by a fine of seven million won, by imprisonment of one year and a fine of seven million won, respectively.
Reasons
The Defendants and C have forged D, E, and cashier's checks, and had D, E and E purchase precious metals and receive the balance in cash by presenting forged cashier's checks in Daegu and Busan Special Metropolitan City as genuine cashier's checks, and have D and E purchase precious metals and receive the balance in cash. The Defendants and C conspired to divide them into D and E.
1. Defendants and C in violation of the Illegal Check Control Act: (a) according to the aforementioned conspiracys with D; (b) Defendant B and Defendant A prepared three million won in cash around April 11, 2019; and (c) D changed the said cash into one check number of three million won in face value at the Pyeongtaek-dong branch of G unions in Daegu-gu, Daegu-gu, to one check number of KRW 3 million at face value; and (c) on April 12, 2019, C changed the said cash to three million won in face value; and (d) on the other hand, C changed the said cash to three million won in face value; and (e) on April 12, 2019, at the top of the International Hotel near the Daegu-gu, Daegu-gu one hotel, a computer and arickter, printed in front of the said original cashier’s checks and in two pages of P36 “P36” paper, and then, D printed in the above I’s book size as above.
Accordingly, the Defendants and C conspired with D to forge the above 3 million won cashier's check number H) in collusion with D.
2. On April 12, 2019, Defendants C and D’s uttering of forged securities, fraud, Defendant A and Defendant B, as indicated in paragraph (1) of the above Article, 30 cashier’s checks, as stated in the above paragraph (1) at the Daegu-gu International Hotel D hotel J around 12, 201, were cut off from C, and then entered in 30 pages of the above forged cashier’s checks in the Pream-gu, Daegu-gu, Seo-gu, Seo-gu, Daegu-gu, in a way of allowing D to take over them.
D In accordance with the public invitation with the Defendants and C, at around 19:00 on April 12, 2019, at the time of purchasing precious metal from the victim “N” shop in the victim M operation of the Sinsan-si, Sinsan-si.
