A defendant shall be punished by imprisonment for one year.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 11, 2013, the Defendant, along with C and D, conspiredd with D’s residence located in Gangdong-gu Seoul Metropolitan Government E, with the victim F, into the 'H’ office located on the 1st floor located in Ansan-gu, Masan-gu, Masan-gu, G, the victim F, to steal the recreation in the area.
Accordingly, on February 11, 2013, the Defendant, along with D, brought a pipeline to be used to damage the knife of the office knife in a warehouse owned by the father of D I located in the Republic of Korea, and C contacted with J and leased the Kknex knife.
At around 21:30 on February 11, 2013, the Defendant, along with C and D, arrived at the office near the victim’s office, after identifying the place where the crime was committed and confirming the surrounding situation, and returned to D around his/her residence. At around 01:30 on February 12, 2013, D waiting at the victim’s office using the above Lone Star car car and arrived at the victim’s office with C along with C, and C waiting at the above office, and C destroyed the pipe car prepared in advance, but C returned to D’s residence.
On February 12, 2013, at around 05:20 on February 12, 2013, the Defendant entered the office of the victim, using the said Lone Star car, and revoked the lock-out system of the office entrance by using the above rank, and the Defendant, together with C, carried the above office door, carried out with C, and carried 36 of the market price of 8,100,000 won, which is the victim’s possession stored therein, and moved to the said office.
Accordingly, the defendant stolen the victim's property together with C and D.
