1. The Defendant’s KRW 50,430,00 for the Plaintiff and 5% per annum from December 17, 2014 to July 21, 2015.
Reasons
1. Facts of recognition;
A. On February 13, 2014, the Plaintiff is an insurer that entered into an automobile insurance contract (from February 13, 2015, up to February 13, 2015; hereinafter “instant insurance contract”) with respect to the instant vehicle owned by Nonparty A (hereinafter “instant vehicle”).
B. The Defendant is a company that has sold the instant vehicle exhaustion (including the preliminary ship reserve, hereinafter “the instant fire reserve”) to A and established the said fire reserve inside the instant vehicle.
According to the evidence No. 1, A recognizes the fact that he/she succeeded to the instant vehicle on February 13, 2014, and according to the evidence No. 3, the Defendant’s installation of an operation in the instant vehicle on October 24, 2013 seems to have been October 24, 2013, but the Defendant did not dispute the fact that he/she sold the instant operation to A, thereby recognizing it as above.
C. On November 1, 2014, around 16:16:16, when the instant vehicle was parked, there was an accident in which the instant vehicle was destroyed by a fire in the front part of the front front of the driver’s seat of the vehicle (hereinafter “instant accident”). D.
The estimated repair cost of the instant vehicle due to the instant accident exceeds the vehicle value, and on December 16, 2014, the Plaintiff paid KRW 58,660,000 to A with the total damage insurance money of the instant vehicle in relation to the instant accident, and around December 2014, returned KRW 8,230,000 for the remainder of the instant vehicle.
E. According to the report on the investigation into the cause of the instant accident, the Korean Fire Investigation Board, an incorporated association, on the instant accident, presumed to have caused severe fire (part) in front of the front floor of the instant vehicle, and have been first emitted from the said equipment (part) and to have expanded the burning. The said equipment (part) is connected to the indoor stringr, one electric wire is cut out from among the connected 12 electric wires, and the stringr is connected with the stringr, and the said stringr is cut off, and the said stringr is lower than the lower side.
