A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
The defendant discovered the telephone number of the Mour guest, and thought that he/she received money from a mobile phone (C) under the name of another person used by him/her by threatening his/her inhuman relationship.
1. On May 29, 2014, at around 14:56, the Defendant: (a) discovered a telephone number from a victim F (the age of 61) who was accommodated in D’s “EM” (hereinafter “EM”); and (b) made phone calls to the victim to the victim, saying, “I would have affixed a photograph that he/she emitted from the MaM. If you do not go, I would see the photograph on the surrounding person and the roadside; and (c) sought to receive money and valuables from the victim who was frighted, but was attempted to receive money and valuables from the victim who was frighted; (d) the victim failed to comply with the request and attempted to do so.
2. On May 29, 2014, at around 15:05, the Defendant: (a) discovered a telephone number from a victim G’s car located in D, and then called to the victim for phone calls to the victim; and (b) attempted to receive money and valuables from a drinking victim, i.e., a mobile phone number of the head of a Tong to be sent to a mobile phone; (c) but failed to perform a attempted act without the victim’s response.
3. On May 29, 2014, at around 15:12, the Defendant: (a) discovered a telephone number from a victim H’s vehicle, which was invested in D, and then called “the Defendant sent money by phone to the victim”; (b) sought money and valuables from the victim who was frightened; (c) but (d) did not comply with the victim’s failure to comply with the request, thereby doing so.
4. On May 30, 2014, the Defendant, at around 15:48, sought money and valuables from a drinking victim, who was frightened in D, by finding out the phone number from a victim I’s vehicle to the victim, and called “the victim, who was frightened, has a photograph coming from the telecom.”
