A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On July 14, 2005, the Defendant was sentenced to one year and six months of imprisonment for fraud at the Seoul Northern District Court, and the execution of the sentence was terminated at the Seoul Northern District Court on December 16, 2005. On November 27, 2009, the Seoul Northern District Court sentenced six months of imprisonment for embezzlement, etc. at the Seoul Northern District Court on November 28, 201, and the said judgment became final and conclusive on January 28, 2010.
The Defendant, in mind, intended to use the F to take over money from F (State) MMM stocks in a clear manner, intended to forge (State) money loan agreements, endorsement confirmations, and (State)MMMs endorsements in the endorsement column.
1. At around 11:00 on May 26, 2008, the Defendant: (a) printed out the form of “money consumption loan contract,” which was stored in the e-mail, at a scam room where the trade name near the Gangnam-gu Office, Gangnam-gu, Seoul, and then affixed the name plate and seal of (MM)M M M M scam, which had been rejected in advance on the debtor’s column.
Then, the Defendant, using a computer, made an endorsement confirmation letter: G, bill number: He confirmed the fact that he endorsed on the said note: . May 2008; .) written out and printed it; stated “H” in the bill number column of the said endorsement confirmation letter using a black pen, and affixed the name and seal of “H” in advance.
As a result, the Defendant, without authority, forged the letter of endorsement in the name of (i) IMM, which is a private document on rights and obligations without authority, and (ii) IMM, which is a private document on a monetary loan contract in the name of (ii) IMM and a certificate of fact.
2. The Defendant: (a) had been aware of the blank Promissory Notes in advance, which was acquired from, and held in possession of, the date, place of entry in paragraph 1; (b) and (c) one column of endorsement of the Promissory Notes issued G.
