A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On April 25, 2019, the Defendant, at the Defendant’s home located in AL at Papju City, posted a letter to the effect that “sale of home appliances” on the Internet AMN car page, using a mobile phone, and made a false statement to the victim EV who reported and contacted the above letter, sent the LG building to the victim EV who sent KRW 1,450,000 for goods.
However, in fact, the defendant was thought to use the price for the goods received from the victim as the refund money to the customers of the order of the provisional goods, and there was no intention or ability to send the goods to the victim because it was not possible to properly receive the provisional goods.
The Defendant, by deceiving the victim as above, received KRW 1,450,000 from the victim to the BD account (Account Number BE) in the name of AS on the same day, and acquired the total amount of KRW 38,150,000 through the same method from April 15, 2019 to July 30, 2019, as shown in the attached crime list.
2. On December 4, 2018, the Defendant, on the crime of this case No. 2020Kadan1500, posted a false statement to the effect that “the sales of Lone Star will be made” on AMN car page using a mobile phone at an unspecified place, and subsequently sent 90,000 won for the goods to the victim EW who reported and contacted the above writing.
However, in fact, the Defendant was thought to use the price for the goods received from the victim as the refund money to the customers of the order of the household appliances, and as the AP could not be supplied with the household appliances because it was locked by the supplier of the household appliances, there was no intention or ability to send the data to the victim.
As above, the Defendant, by deceiving the victim, received 900,000 won from the victim to the A Qa Bank Account (AR) account under the name of the Defendant on the same day.
