1. As to Defendant B’s KRW 279,423,00 and KRW 201,00 among the Plaintiff, Defendant B’s KRW 78,423,00 shall be KRW 78,423,00.
Reasons
1. Basic facts
A. The “C Project” construction contract 1) Defendant B is the C Project Corporation (hereinafter “instant construction”).
In order to implement the construction contract, the Plaintiff was selected as the successful bidder of the instant construction contract between the Defendant and the Republic of Korea. (2) The Plaintiff entered into a construction contract with respect to the instant construction project on May 21, 2013, including ① the contract amount of KRW 6,221,415,00 and May 27, 2013 to November 17, 2014, and entered into a total construction contract (6,980,375,000) and the total construction period (from May 27, 2013 to March 17, 2015) with respect to the instant construction project from May 27, 2013 to June 19, 2013 to the construction period of KRW 758,96,000,000,000, and the construction period of KRW 1375,000,000 from May 27, 2013 to March 17, 2014
(3) The criteria for tender and execution of contracts by local governments incorporated into the instant construction contract (amended by the Rules of the Ministry of Safety and Security No. 26, Mar. 26, 2013; hereinafter referred to as the “instant general conditions”) are as follows: (a) the agreement on the total construction amount and the total construction period additionally stated as above concerning the instant construction contract; and (b) the criteria for tender and execution of contracts by local governments incorporated into the instant construction contract (hereinafter referred to as “instant general conditions”).
The main provisions relevant to the instant case shall be as shown in the attached Form.
B. An amendment to the terms and conditions of a contract for the second multiple contracts: (a) on June 19, 2013; (b) on March 17, 2015; (c) on December 18, 2014; (d) on March 17, 2015; (d) on March 31, 2015; (d) on March 31, 2015; (e) on the amendment to the terms and conditions of a contract for the second multiple contracts; (e) on March 31, 2015; (e) on the amendment to the terms and conditions of a contract for the second multiple contracts; (e) on the first half; (f) on the amendment to the terms and conditions of a contract for the second multiple contracts; (f) on March 17, 2015; (f) on the amendment to the terms and conditions of a contract for the second five contracts; (f) on June 23, 2015; (f) on the amendment to the terms and conditions of a contract;
