A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

The defendant is the assistant officer of the 19th National Assembly member E, who belongs to C party, and is a public official of Grade IV in special service belonging to the National Assembly.

At the time of May 2009, the Defendant came to know H through the introduction of G representatives of the above local constituency while performing the duties of management of the local constituency in the position of secretary general at the Busan local constituency office as an assistant officer of the National Assembly member E who belongs to the F Party.

On September 10, 2009, the Defendant: (a) provided H, K and K with L L, and provided a meal at the J hotel restaurant located in Suwon-gu, Busan; (b) and (c) provided H and K with H, “K to promote K to the former office of M in the past year; (d) the Director General was promoted to the former office; and (e) the current N, the President of L, at the request of N, to the Minister of Knowledge Economy or the senior public official of the Ministry of Knowledge Economy through the National Assembly member, would be able to promote the former office if requested by the Minister of Knowledge Economy or the senior public official of the Ministry of Knowledge Economy of the Ministry of Knowledge Economy; and (e) provided H and K with the same purport as “I will be able to promote the former, if the latter is a high school of an E member; and (e) it was known that I would be promoted, once again, I agreed to the effect that I will be promoted.”

1. On November 20, 2009, the Defendant demanded money and valuables to the effect that “I will find one cash, and enter the office, because I will find you in one cash.” On the same day, I received KRW 10 million in cash from H at the local constituency office of National Assembly member E of the 5th floor of Busan Building.

Accordingly, the defendant received money and valuables under the pretext of soliciting the affairs handled by the public officials.

2. On January 25, 2010, the Defendant demanded money and valuables to the effect that “8 million won will be prepared as a fake,” by posting a phone to H from the French land not exceeding Busan, and on the same day, the Defendant is front of the Kaco Center near Busan, Daegu, Busan.
