B is the Dong representative of Mapo-gu Seoul Metropolitan Government D apartment 14, and the defendant A is the Dong representative of the same apartment.

1. 피고인 B의 범행 피고인은 2013. 3. 12. 09:00경부터 같은 날 10:00경 사이에 D아파트 관리사무소에서 피해자 E가 소속된 주식회사 세화종합관리 직원 20여 명과 아파트 동대표 등 불특정 다수인이 있는 자리에서 위 E를 지칭하여 "소장 새끼가 꼼짝도 못하는 새끼가, 양아치 같은 새끼들을 끌어 모으는 데가 아니다. 내가 어제 그저께 당신들이 소장 놈하고 회장하고 차타고 가는 것을 확인해 놨다"고 말하여 공연히 허위의 사실을 적시하여 피해자의 명예를 훼손하였다.
