1. The defendant,

A. Of the 919 square meters JJ in Chungcheongnam-gun, the Plaintiff A indicated in the attached drawings 1, 2, 3, 4, 5, 6, 7, 7.

1. Basic facts

A. On May 11, 1913, K was assessed against JJ 919 square meters (hereinafter “instant land”).

As K died on March 19, 1961, the heir of M, including N, who was born between the former wife L, and the heir of M, including N, who had been born between the former wife L, succeeded to the property of the Defendant, his wife, R, S, and Q, who was born between the former wife L and the former wife Q (Death at the time of commencement of the inheritance) and Q, and who was born between O, P, and the latter Q (Death on November 17, 2003) and Q.

나. U는 1995. 10. 10. 이전부터 이 사건 토지 중 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㅅ, ㄱ의 각 점을 차례로 연결한 선내 ㈎부분 424㎡(이하 ‘이 사건 토지 ㈎부분’이라 한다) 지상 주택에 거주하면서 이 사건 토지 ㈎부분을 점유하다가 2010년경 사망하였다.

A는 2013. 5. 20. U의 맏아들인 V으로부터 이 사건 토지 ㈎부분과 그 지상 주택을 매수하여 현재까지 이를 점유하고 있다.

다. W(일명 X)는 1994. 10. 10. Y으로부터 이 사건 토지 중 별지 도면 표시 ㄱ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, ㄱ의 각 점을 차례로 연결한 선내 ㈏부분 495㎡(이하 ‘이 사건 토지 ㈏부분’이라 한다)와 그 지상 주택을 매수하여 이를 점유하다가 2014. 5. 16. 사망하였다.

2. The Defendant’s judgment on the defense prior to the merits asserted that the instant lawsuit seeking the registration of ownership transfer against the Defendant among K’s inheritors is unlawful.

However, the plaintiff is not only seeking the registration of ownership transfer only for the defendant's share of inheritance, but also the person asserted as the performance obligor by the plaintiff has the standing to be the defendant in the performance lawsuit. Therefore, the defendant's defense is without merit.

3. Judgment on the merits.
