A defendant shall be punished by imprisonment for three years.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

1. On January 13, 2015, the Defendant: (a) accessed the victim C (here, 12 years of age) scheduled to enter a middle school through the mobile Messenger “D”, and then divided conversations between the victim and the female 17 years of age; and (b) was sent the victim’s face and chest photograph by seeking to confirm whether the female is female.

피고인은 피해자가 진학할 중학교의 남학생인 것처럼 행세하면서 피해자를 만나 그녀를 간음할 것을 마음먹고, ‘라인’을 통하여 피해자에게 “그 중학교의 잘 나가는 애들이 타락한 애를 원하고 있는데, 걔네가 섹스를 하자고 할 수도 있지, 그걸 하면 왕따를 당하지 않게 해 줄게. 왕따를 당하지 않으려면 친해져야 되지 않겠냐.”는 메시지를 보냈다가, 피해자로부터 성교에는 응할 수 없다는 취지의 답장을 받자 “내가 그렇게 호구 같냐 네 이름이랑 학년, 네가 왜 오기 싫은지 모두 후배들한테 이야기 해버릴 거야.” 등의 메시지를 전송하여, 피해자가 성교 요구에 응하지 않으면 학교에서 집단 따돌림을 당하게 할 것 같은 태도를 보였다.

Although the Defendant intended to have sexual intercourse with the victim, who is a minor under the age of 13 by giving and exerting force, the Defendant did not inform the family of the above fact and reported it to the police and did not intend to do so.

2. The Defendant, in violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials), recruited members of the Defendant from around 2012 to around March 12, 2015 via the “Massenger”, “Kakakao Stockholm”, and “Stockholm” to female elementary school students and middle school students in Yeonsu-gu Incheon.
