Punishment of the crime

The Defendant works as the representative director of Gangnam-gu Seoul AF building, SNS, 402, software development business, etc., and is a person in charge of overall control over the affairs of AG, AH, etc., a company B related company.

The Defendant developed the “B” which is a kind of mobile phone cryp case, and then, thought that “B” users of the mobile phone cryp case as its members and that they may enjoy profits from using the “B” cryp case. The Defendant controlled B’s development and supply of the “B” cryp case in “B,” which was developed by B in AG, intended to receive advertising from the franchise store by soliciting the franchise store through the “B” cryp case, and to develop the technology of the “B” case in AH.

The aforementioned “B” case is a mobile application, the main function of which is to translate and transmit messages to other languages, such as English, while performing the function of both sides and multilateral mals, and which is to transmit text messages. On October 2014, the Defendant: (a) made the instant “B” case by granting the development cost of KRW 200 million to a mobile application manufacturer, a company, an AI, the term of completion of development, to January 2015; and (b) completed the production of the “B” case; (c) however, the Defendant developed the wife (China’s Chinese nationality) of the AJ, which was known to the general public, but added only the function of changing the design of the “AK” case and improving the function of the new content and building a new content.

However, “B” case manufactured as above did not reach the degree of communication, and was not a new content added to “B”, and was found to have a variety of defects in the program, thereby constituting the basic function.
