Reasons
Punishment of the crime
The Defendant was a person who operated beauty rooms in Goyang-gu E, Gyeyang-gu. The Defendant invested in real estate such as purchase of officetels with loans, but the real estate price has decreased and the beauty room operation has not been operated well, and thus, the obligation related to real estate is approximately KRW 400 million, and as a result, the Defendant was unable to cope with interest on loans, he was able to borrow money from those who borrowed money to appropriate for the repayment of existing debts.
1. On April 10, 2009, the Defendant was transferred 15 times in total from the victim’s account under the name of the Defendant, including the transfer of 20 million won to the account in the name of the Defendant, 15 times in total, including the transfer of 20 million won from the victim to the account in the name of the Defendant, on April 10, 2009, by stating that “If the Defendant borrowed money from the Defendant, despite having no intent or ability to repay the principal, the Defendant would lend money to the other party and would receive interest on the second part of the month.”

The Defendant, around March 29, 201, falsely stating that “If he/she lends money to another person to pay money to him/her even though he/she has no intent or ability to repay the principal even if he/she borrowed money, he/she shall lend money to the third person, and shall receive interest on the second or fifth or fifth or fifth or half of each month, he/she shall be held responsible for the principal,” and that he/she receives money from the victim to the Defendant’s national bank account on May 16, 201, and receives KRW 25 million from the victim’s national bank account on May 16, 201, KRW 10 million on May 23, 2011, KRW 10 million on May 23, 201, KRW 10 million on January 2, 2012, KRW 10 million on January 2, 201, and the same year.
1. A person received a total of 75 million won from a remittance on December 12, 2000 won;
3. On September 20, 201, the Defendant: (a) at the beauty art room around September 20, 201, the Defendant, despite having no intent or ability to repay the principal even if having borrowed money, paid money to the Victim J (W, 64 years of age).
