However, in fact, the Defendant did not have any goods sold at the time, and was thought to use the goods for living expenses with money from the victim, so there was no intention or ability to sell the goods to the victim from the beginning.

Ultimately, the Defendant, by deceiving the victim as such, received KRW 50,00 from the victim to the Agricultural Cooperative account in the name of E as the price for goods on the same day, and acquired the total amount of KRW 603,00 by the same method through 12 times from that time to May 19, 2016, such as the statement in the list of crimes in the attached Table.

2. 피고인은 2016. 4. 22.경 대구 동구 율하동에 있는 율하공원 인근에서 피해자 F이 인터넷 포털사이트 네이버 ‘중고나라’ 카페에 ‘고성공룡엑스포 할인권 구합니다’라고 구매글을 올린 것을 보고 피해자에게 전화하여 ‘고성공룡엑스포 표 값을 송금하면 등기로 표를 보내주겠다’고 거짓말 하였다.
