Defendant shall be punished by a fine of KRW 700,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

Defendant,

1. On June 7, 2003, at the “D” office located in Gwanak-gu, Seoul Special Metropolitan City, the name and resident registration number of E in the customer column of the application form for mobile telephone use without authority, stating the name and the resident registration number of E in the verification color pen in the applicant column, and signing the application form for mobile telephone use in the same manner, signing each of the above mentioned items on the purchaser column of the site of the contract form for mobile terminal use, thereby forging each of the application form for mobile telephone use in the name of E and one copy of the contract form for mobile phone use in the name of the private document related to rights and obligations;

2. In filing an application for the use of mobile phones at the same date and time as in paragraph 1, at a place as in the above, each of them shall be held by submitting to the injured party C (hereinafter referred to as 48 years of age) an application for the use of mobile phones and as if the contract for the use of the mobile phone was duly formed, and exercising each of them as if the application was duly completed. By doing so, the above document shall be obtained from C, i.e., a mobile phone (F) terminal value of KRW 558,500, which is believed to be authentic, from which it shall be obtained from the third party who believed to be genuine, and shall acquire the pecuniary benefits equivalent to the above amount by using

3. On June 9, 2003, without authority, forgees a written application for mobile telephone use in the name of E, which is a private document concerning rights and obligations, in the same manner as paragraph 1 and forges a contract for mobile telephone use in the name of E, and a contract for mobile phone use in the form of a device;

4. To exercise the application form for the use of mobile phones and the sales contract form for the terminal to C in the same manner as that referred to in paragraph 2 at the same time and place as that referred to in paragraph 3; to obtain from C the amount equivalent to 58,500 won of the market price of one mobile phone (G) in the seat from C; to acquire it by deceiving it; from that time, by using the aforementioned mobile phone from September of the same year the pecuniary benefits equivalent to 39,800 won shall be acquired;

5. Paragraph 1 and 2 of this Article are without authority for the purpose of exercising at “D” office around September 4, 2003.
