Reasons
Punishment of the crime
On March 27, 2014, the Defendant was sentenced to imprisonment with labor for fraud, etc. at the Busan District Court on April 7, 2014, and the judgment became final and conclusive on April 7, 2014.
The Defendant returned to the nationwide mobile phone sales store using personal information, such as another person’s resident registration number and address known to him through the Internet search, and then sold the mobile phone in another person’s name and conspired to raise money and valuables by disposing of the mobile phone.
At around 19:00 on March 4, 2013, the Defendant used F personal information, which was known to the victim D operation E information and communication of the victim in North Korea, from around 19:00 on March 4, 2013, and conducted as if BF, and made a false statement by changing two cell phoness in the name of F.
In order to open a mobile phone with B, without authority, the Defendant drafted a new contract for the SK Telecom and two copies of the contract for the terminal, and entered the resident registration number into “G”, “F”, “F”, and “H apartment 104 Dong 201 in Busan-si, H apartment 104 Dong 201” in the customer information column where the Defendant applied for joining the location of the location, and signed it in the name of F, respectively, with the intent to use the mobile phone together with B, and immediately deliver the forged SK Telecom new contract and two copies of the contract for the terminal to use it as if they were duly formed, and the Defendant received from the victim D a delivery of approximately KRW 2,178,00,00 in the market price of Samsung G GY 2, 22, and 2,178,000.
As a result, the Defendant, in collusion with B, forged Chapter 4 of the private document in the name of F, which is a private document on rights and obligations for the purpose of uttering, and exercised four copies of the forged private document, and acquired two cell phones of the market price of KRW 2,178,00 by deceiving the victim D.
