1. The Defendant: (a) 28,00,000 won to Plaintiff A; (b) 64,825,116 won to Plaintiff B; and (c) 64,825,116 won to each of the above amounts, from May 16, 2013 to May 2014.

1. Occurrence of liability for damages;

A. The facts of recognition (1) The Defendant is an individual entrepreneur operating a business entity that operates machinery, metal painting, or other disposal business, and E has been working at the Defendant’s workplace since June 2012, and the Plaintiff is the wife of E and the Plaintiff B are the children of E.

(2) On May 15, 2013, E around 13:55, at the Defendant’s workplace located in Ansan-si Group F, with other workers G, H, and I, conducted the work of moving steel structure (157cmx250cmx25cm, weight 1 ton) to the ice book-keeping (hereinafter “instant work”). E was in charge of removing the parts of the steel structure and moving to the painting book-keeping, rather than broad side of the said steel structure, and was pushed down with the upper part of the narrow side of the building, not large side of the steel structure.

During this work, the said steel structure goes beyond the direction of E, and e was shocked, and as a result, E was killed in the same place by suffering injuries, such as cerebral blood and dubulululization.

(3) With respect to the instant accident, the Defendant was indicted by the Suwon District Court for the violation of the Occupational Safety and Health Act and the occupational negligence resulting in death, etc., and the above court on December 20, 2013, the business owner shall take necessary measures to prevent risks caused by machinery, apparatus, and other equipment when operating a business. In the event that the employees are engaged in the work at a place where the objects fall or are likely to fall off during the work, the business owner shall prepare a work plan including the matters that can prevent accidents, such as fall, fall, fall, electric shock, collapse, collapse, etc., in order to prevent the danger of workers, and shall designate an ordering person to instruct the work in accordance with the work plan, but shall instruct the work in accordance with the work plan.
