A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, who served as an insurance solicitor for Samsung Life Insurance Co., Ltd., was willing to arbitrarily terminate the insurance contract in the name of Samsung Life Insurance Co., Ltd., which was subscribed at the Defendant’s solicitation, and to acquire refund money;

On February 11, 2008, the Defendant terminated an insurance contract with the victim Samsung Life Insurance Co., Ltd. under C as if the Defendant was C, and acquired KRW 1,878,800 as refund money from the above victim to C bank (Account Number: D) account.

2. On October 2, 2010, the Defendant, who used a computer, etc. against the victim Samsung Life Insurance Co., Ltd., filed an application for a loan with the victim Samsung Life Insurance Co., Ltd. to enter his/her personal information, such as the resident registration number, in spite of the fact that he/she did not obtain permission from C, and then received KRW 140,000 from the victim to the national bank account as stated in paragraph (1), from that time until August 2, 2011, and acquired KRW 970,000 over nine times as stated in the attached list of crimes (1).

3. The Defendant arbitrarily prepared an application for a loan in the name of C with respect to the forgery of a private document against the victim lending companies, the uttering of a falsified document, and the fraud, and had the intent to acquire the loan from the lending companies.

On February 29, 2008, the Defendant prepared a loan application form with the name of C and the resident registration number, etc. of C in the personal data column of the obligor while the Defendant took place as C at the location of Gangseo-gu Seoul Metropolitan City, etc., and submitted it to the employee in charge of the social loan of C&P to the victim.
