Reasons
Criminal facts
A person who intends to run a brokerage business shall register the establishment of a brokerage office with the registration authority that intends to establish a brokerage office. However, on July 17, 2010, the defendant filed a complaint with the registration authority for the establishment of a brokerage office with regard to the size of 2007 square meters in G real estate consulting office located in the Gyeonggi-gun, which is located in the Gyeonggi-gun, for the purchase and sale contract between I and L which is the owner, and on September 10, 2010, the public prosecutor of the sales contract between I and L on the premise that A purchased the above real estate from I and sold it to L on the condition that B, as seen below in the judgment of innocence, the parties to the above sales contract appear to be "I" and L, and thus, the defendant did not exercise his right to defense as seen above, even if the parties did not exercise their right to defense, Article 48 of the Act on Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions, which punishs the registration without registration, and the parties did not change the sales contract.
10,000 won was received as a brokerage commission, and the unregistered brokerage business was operated.
