Punishment of the crime
Defendant
A is in the relationship between H and the sixth degree of family members of the victim G clan, and Defendant B operates the real estate office with the trade name of J from around 2009 to H and elementary school house, and Defendant C is a person who works as an office at the L Licensed Real Estate Agent Office located in Gyeonggi-si to the end of 2011 and operates the same real estate office without a licensed real estate agent at the same place from May 11, 201.
1. The Defendant violated the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement) of Defendant A, along with M around December 16, 1970, received title trust from the said victim’s clan 31,052 square meters of N Forest land owned by the said clan, and completed the registration of ownership preservation in the joint name of the Defendant and M in the name of the Defendant.
After the death of M on January 20, 2003, H transferred his/her share in the name of M, and the Defendant, while keeping the said forest for the said clan with H, in violation of his/her duties, sold the said forest land to H at his/her own discretion with H in KRW 1.2 billion with H on December 27, 201, and completed the registration of transfer of ownership with regard to the said real estate in the branch court of the said Suwon District Court on February 10, 2012.
Accordingly, the Defendant, in collusion with H, embezzled the above forest land equivalent to KRW 1.2 billion at the market price of the victim clan.
2. Any person who intends to run a brokerage business in violation of the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act by Defendant B shall register the establishment of a brokerage office with the competent registration authority.
Nevertheless, the defendant introduced the seller's side at the above real estate office operated by the defendant around December 27, 201, without registering the establishment with the registration authority, and C introduced the buyer's side and introduced the buyer's side to the forest land as stated in Paragraph 1 between H, A and P.
