1. The Defendant shall pay to the Plaintiff KRW 46,140,930 and the interest rate of KRW 15% per annum from September 6, 2017 to the day of complete payment.
Reasons
1. Facts of recognition;
A. On October 4, 2016, the Plaintiff concluded a sales contract with the Defendant to sell buildings listed in the separate sheet (hereinafter “instant building”) under the following conditions (hereinafter “instant sales contract”).
1) Price: 221,00,000 down payment KRW 2) 10,000 on down payment; KRW 133,000,00 on the first intermediate payment by October 8, 2016; KRW 30,000 on the second intermediate payment by December 30, 2016; and KRW 48,000,000 on the remainder by March 31, 2017.
3) If the Defendant fails to pay an intermediate payment or any balance within a fixed period, the Defendant shall pay the unpaid amount plus damages for delay calculated at the rate of 15% per annum. B. The Defendant paid the down payment and the first intermediate payment to the Plaintiff by October 10, 2016, and received the instant building from the Plaintiff by December 30, 2016, and paid 20,000,000 out of the second intermediate payment, and thereafter refused to pay the remainder of KRW 58,00,000 for the reason that there were defects such as rupture, strings, strings, strings, subsidences, destruction, water leakage, installation, or contact volume of the instant building. The Plaintiff prepared for the Plaintiff’s ownership transfer registration of the instant building on September 4, 2017, and demanded the Defendant to obtain the remainder of the registration of ownership transfer, including the certificate of completion of registration for real estate sale and the certificate of seal impression affixed to the Defendant, and the remainder of the instant building 1.7.
