A. The Defendant succeeded to the status of the executor in accordance with the management-type land trust agreement entered into between Haman C&C Co., Ltd., the executor of the building project of Ulsan-gu apartment building B.

The defendant assistant intervenor is the construction of the above apartment complex.

B. On October 16, 2009, the Plaintiff concluded a sales contract with the Defendant for the said apartment No. 106-dong 801 (hereinafter “instant apartment”) and completed the registration of ownership transfer on July 13, 201.

2. The assertion and judgment

A. (1) The Plaintiff asserts that there is a defect in the apartment of this case, and sought payment of KRW 14,912,985 for the defect repair cost.

(2) In light of the result of the appraiser C’s appraisal of the above appraiser on April 25, 2017, in full view of the purport of the argument as a result of the fact inquiry by the appraiser C on April 25, 2017, the apartment of this case has the following defects, and it is recognized that 14,912,985 won is necessary as the defect repair cost.

[2] According to the fact-finding conducted on April 25, 2017 on the appraiser of this Court with regard to the defective items 1 through 5, 6 through 8, 10 through 12 of the following table, it is recognized that defects in aesthetic view may occur in the part of the defect in question, and it shall be calculated at the total replacement cost.
