피고인은 2013. 8. 28. 21:30경부터 같은 날 22:00경까지 안양시 만안구 B에 있는 ‘안양만안경찰서 C지구대’에 술에 취한 채로 찾아가 “빽차로 집까지 태워달라는데 왜 안 태워 주느냐”라고 소란을 피우자 그곳 상황근무를 하던 순경 D(27세)이 귀가를 종용하자 “내가 집에 태워다 주라고 하는데 왜 안 태워 주냐. 씨발 같네”라고 하는 등 욕설을 하였다.
