1. Defendant A’s imprisonment for 10 months, Defendant B’s fine of 3,00,000 won, and Defendant C’s fine of 5,00,000 won, respectively.
Reasons
Punishment of the crime
1. Defendant A is a person who operates D (T) where he/she supplies opical experiment equipment, equipment, and materials.
Around November 2015, the Defendant: (a) called the Head of the General Headquarters of the H project Group, which belongs to the F University (G) Industry-Academic Cooperation Foundation, to purchase the surface view measuring instrument through a bid by the Public Procurement Service; (b) around that time, the Defendant sent estimates and specifications to I, etc. to enable the Defendant to award a contract; and (c) around July 27, 2016, I submitted to the F University Secretariat purchase team the surface altitude measuring instrument with the specifications, etc. written in accordance with the aforementioned pre-determined ratio, etc.; and (d) requested the F University Secretariat to purchase the product in accordance with the product specifications stated in the “request and the product specifications” submitted by I around October 2016.
The Defendant, while participating in the tender around October 28, 2016 at the Daegu Local Government Procurement Service, made K enter the bid at KRW 76,690,00,00 of the bid price, and made K enter the bid at KRW 76,690,00 of the bid price, and made K enter the bid at KRW 76,40,00 of the bid price to obtain the Defendant’s bid price. Accordingly, the defendant, in collusion with I, conducted a bidding process conducted at the F University or the Public Procurement Service in connection with the business of the project team by fraudulent means.
