A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On September 2009, the Defendant: (a) stated “F”, “F”, “F”, and “F” in the English name column; (b) “B”, “W-mail column in the Handphone number column; (c) stated in the Account Number column, “Korea”, “J”, “F”, and “F” and “F” in the Account Number column; and (d) presented the phone number column in the Account Number column, “F”, “F”, and “F” and “B” in the Account Number column; and (c) the phone number column in the Telephone column, “L”, “L-402”, “L”, “F”, and “F”, and “F” in the Telephone column, and “F” and “F” in the phone number column, and presented it to the account holder, who is a member of the e-mail, for the purpose of exercising rights and obligations by signing in the name column and side of the member column.
Accordingly, the defendant forged the application for membership in the name of F, a private document, and held it.
2. The criminal defendant was willing to receive goods or services from the victims who are franchisees of credit cards, using Samsung Cards issued in the name of F.
On March 31, 2013, the Defendant: (a) visited the victim’s name in Seoul Special Metropolitan City, Gwanak-gu, Seoul Special Metropolitan City, and the first floor NM to purchase goods worth KRW 10,000; and (b) received goods by presenting the above Samsung Card to the person who was not in charge of his name for the purpose of paying the price; and (c) from February 28, 2014 to February 28, 2014, as indicated in attached Table 1 (excluding No. 136 annually) of the daily list of crimes (i.e., 23,126,920 won) by deceiving the victims to receive goods or services equivalent to KRW 23,126,920 through 304.
3. On April 3, 2013, the Defendant: (a) called the victim Samsung Card Co., Ltd.’s representative telephone, 1588-8700; and (b) notified an employee whose name cannot be known, of the said F’s personal information, and confirmed his/her identity.
