Punishment of the crime

"2018 Highest 1031"

1. On May 11, 2017, the Defendant committed the crime against the victim B: (a) made a false statement by phone call to the victim B, stating that “If a photograph and resident registration number are sent, a credit card will be registered as an E company partnership card; (b) obtained from the victim’s cell phone pictures and resident registration numbers in the victim’s name; and (c) obtained information on the victim’s credit card such as the victim’s resident registration number, credit card number, effective period, etc.; (d) entered the victim’s resident registration number, credit card number, and effective period into the H computer program used in the above agency without authority; and (e) obtained financial benefits equivalent to 723,400 won for the payment of the victim’s communications fee; and (e) obtained financial benefits from the same amount from the time to July 13, 2017 by using the victim’s resident registration number, credit card number, and information, such as the victim’s resident registration number, credit card number, effective period of validity; and (e) obtained financial benefits equivalent to the same amount.

Accordingly, the defendant acquired property benefits by inputting and changing information without authority in a computer or any other information processing device, and made a credit card transaction using other person's credit card information detected by fraud or other improper means, and unlawfully used other person's resident registration number.

2. Crimes against victims I;

A.
