A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[criminal history] On August 12, 2015, the Defendant was sentenced to six months of imprisonment for a crime of violating the Road Traffic Act at the Gwangju District Court on February 23, 2016 and completed the execution of the sentence at a military prison on February 23, 2016.

[Criminal facts]

1. On February 1, 2017, the Defendant, including a computer, entered the victim D’s visa number, password number, validity period, etc. in charge of filling in the Defendant’s mobile phone via the Defendant’s mobile phone from the scam room where the name located in the Dong-dong, Daejeon is unknown, with the Defendant’s mobile phone on February 1, 2017. The Defendant paid 92,160 won to the victim’s bank account and deposited the said amount from February 1, 2017 to March 2, 2017, and paid 92,160 won to the victim’s bank account by the same method as in attached Form 307 by arbitrarily inputting the victim’s 30 card information, such as the list of crimes (1) again, 21,013,180 won.

Accordingly, the Defendant, in collusion with C, etc., entered information into a computer or other information processing device without authority, thereby obtaining pecuniary benefits equivalent to the above amount.

2. No person in financial business specializing in credit finance shall possess other persons' credit card information detected by fraud or other improper means, or make a transaction by credit cards by using such information;

Nevertheless, the Defendant in collusion with C, etc., using credit card information, such as the card number, password, effective period, etc. of D’s card number, which was acquired in an irregular manner at the same time and place as the above paragraph (1), charged with D’s credit card and traded with D’s credit card from February 1, 2017 to March 2, 2017, and in the same manner, 20,603,580 won in total by using 29 credit card information in the same manner as the list of crimes in attached Form (2).
