A defendant shall be punished by imprisonment for four months.

Punishment of the crime

1. The Defendant: (a) died on February 3, 2018; (b) the Defendant thiefeded that B had a physical card in the name of B that he left to the Defendant before his birth; and (c) had the money deposited in B’s account in the name of B, with the intention to withdraw and use it.

On February 4, 2018, the Defendant collected 6,680,400 won in total on 12 occasions, as described in attached Table 1, from that time to August 9, 2018, and then stolen the amount of money managed by the victims, by inserting 901,00 won, which was kept in the D Bank Account (E) in the name of D Bank (E) in the name of Seongbuk-gu Seoul, and inputting the password, which was known in advance.

2. On March 2018, the criminal defendant, on the part of the victim F (ju), told the employee in charge of false name care as he/she had her as if he/she was B, and said, “I want to terminate the existing low-term period of time at present at the time when he/she had been insured.”

However, in fact, the Defendant terminated the above insurance while receiving a refund for termination from the victim, and thought to be used for personal purposes, and there was no delegation or consent from B on the termination of the above insurance.

Nevertheless, the Defendant, by deceiving the victim as above, received 695,847 won from the victim to the G bank account in the name of B on April 4, 2018, and fraudulently acquired it.

3. On February 3, 2018, the Defendant: (a) died on February 3, 2018; (b) had been willing to purchase goods to be used for personal purposes using the H-cooperative body card in the name of B kept by B before the birth; and (c) on February 8, 2018, B had not returned the said body card to B, the heir of B, despite having been able to return it.

After that, the Defendant was the victim on April 18, 2018.
