A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On May 11, 2018, the defendant received and kept C Bank's credit cards and D Bank's physical check cards in the name of the victim from the victim B bound by the law in the Gwangju District Court.

1. From July 13, 2018 to August 27, 2018, the Defendant received the 500,6222 won in the “E” for the operation of the victim in the name unclaimed in Gwangju (hereinafter referred to as “E”), and subsequently paid the price, as if the Defendant was the lawful holder of the credit card of the said Cbank, he/she had delivered the price to an employee in the name unclaimed, and had paid the price. From July 13, 2018 to August 27, 2018, the Defendant acquired the pecuniary benefits equivalent to the said amount by deceiving the victims in the name unclaimed in each business establishment, who were the business owner of each business, on a total of 21 occasions, as shown in the List of Crimes (1).

2. On July 8, 2018, the Defendant transferred total of KRW 16,620,40,000 to G bank accounts in the name of the Defendant’s mother-friendly title, including transfer of KRW 151,00,00 by inserting the said card in the cash payment unit of the victim D bank management, even though there was no right to use the said D bank’s check at a location below Gwangju, Gwangju around July 8, 2018.

Accordingly, the defendant acquired financial benefits equivalent to 16,620,40 won by inputting information into a computer or any other information processing device without authority.

3. From July 10, 2018 to July 22, 2018, the Defendant withdrawn KRW 1,570,000 in total seven times, as indicated in the attached Table of Crimes (3) from that time, the Defendant, even though he did not have the right to use the said D Bank’s physical card, entered the said card into the cash payment card inputs of the victim D Bank’s management and withdrawn a password of KRW 400,00,000, which was already known.
