Defendant
A shall be punished by imprisonment with prison labor for eight months and by a fine of ten million won, and imprisonment with prison labor for one year and by a fine of ten million won.
Reasons
Punishment of the crime
[criminal history] Defendant B was sentenced to a suspended sentence of ten months on April 2017 by the Seoul Western District Court on April 12, 2017 for a violation of the Act on the Punishment of Acts such as Intermediating, etc. of sexual traffic (such as brokerage, etc. of sexual traffic) and the suspended sentence became final and conclusive on April 20, 2017.
[2] On January 1, 2017, the Defendants: (a) leased an officetel in Jongno-gu Seoul Metropolitan Government 7868, 2017, 8438 (Defendant B) to operate a commercial sex business establishment by leasing the officetel in Jongno-gu Seoul Metropolitan Government; (b) Defendant B conspired to manage female employees of commercial sex acts, to advertise commercial sex acts, to recruit customers, etc.; and (c) Defendant A conspired to provide the name necessary for the officetel lease agreement and to play a role of paying monthly rent and management expenses for commercial sex acts; and (d) Defendant A leased six officetels in Jongno-gu Seoul Metropolitan Government 310, 1314, 1406, 1410, and 1410, and leased six officetels in Seoul Jongno-gu under the name of the Defendant, including Seoul Etel 310, 1314, 1406, and 1410; (c) advertisement with the trade name “G”, “G”, “H”, “I, etc.” as an Internet site for commercial sex acts.
Defendants conspired, around 20:00 on September 20, 2017, the Defendants: (a) had female employees K receive KRW 100,000 from N that reported the Internet commercial sex acts; and (b) had them look at the sexual organ of the same person by hand; and (c) received KRW 40,00 from K as intermediary fees.
In addition, from August 2016 to September 20, 2017, the Defendants conspired to have the said female employees receive 80,000 to 140,000 won from many unspecified male customers in exchange for the price of sexual traffic, and had them receive 80,000 to 140,000 won, and then received 40% of the price of sexual traffic under the pretext of brokerage fees and received 40% of the price of sexual traffic, thereby engaging in the act of arranging sexual traffic.
