Defendant
A, B, and C shall be punished by a fine of KRW 5,00,000, and Defendant D shall be punished by a fine of KRW 7,000,00, respectively.
The defendants are the defendants.
Reasons
Punishment of the crime
1. No defendant A constructor shall subcontract electrical construction works he/she has contracted to another constructor;
Nevertheless, the Defendant was awarded a contract for the “Maintenance and Repair Work for the Revised-gu Revised-gu 2014 (the completed amount: 482,936,000 won)” with the trade name “H” on the G and the first floor of Gyeyang-gu Mayang-gu Dayang-si Ga, and the construction work was subcontracted on the condition that D, who operates the KCAI, would pay 75% of the completed construction amount of the construction work, from February 2014 to February 2, 2015, ordered by the Sung-nam city accounting division of Sung-nam-si 2014.
Accordingly, the Defendant subcontracted the contracted electrical construction to other constructors.
2. No defendant B constructor shall subcontract electrical construction works he/she has contracted to another constructor;
Nevertheless, the Defendant awarded a contract for the maintenance and repair works for the modified air traffic signal, etc. (the completed amount: 49,850,000 won) in 2015 with the content that he/she would maintain and repair the traffic signal, etc. in Seongbuk-si from February 2, 2015 to February 2, 2016, while running the electric construction business with the trade name "K" in Pyeongtaek-si J. However, the Defendant awarded a contract for the said construction works on February 2, 2015 on the condition that he/she would pay 70% of the completed amount of the said construction works to D who operates the LAWC, and subcontracted the said construction works to D who operates the LA.
Accordingly, the Defendant subcontracted the contracted electrical construction to other constructors.
3. No defendant C constructor shall subcontract electrical construction works he/she has contracted to another constructor;
Nevertheless, the Defendant is running the electric construction business with the trade name "M" in Suwon-si L and 2, and the Defendant maintains and repairs traffic signals, etc. ordered by the Sungnam-si accounting division around February 2016 from February 2, 2016 to February 2017, 2016.
