1. The defendant is the plaintiff (appointed party) and the attached Form

Reasons
Basic Facts
On December 24, 1996, the Defendant entered into a trust contract and newly built D buildings with E Co., Ltd. (hereinafter referred to as “E”; in the name of each company, the part of the Co., Ltd. is omitted) and completed the registration of ownership transfer on the same day with respect to the above G and H land on the ground of the Seoul Jongno-gu Seoul Metropolitan Government F large 2,17.4m2m2m2, the above H large 458m2m2m2 (hereinafter referred to as “instant land”) (hereinafter referred to as “D”) to newly construct and sell the aggregate building “D” on the ground of the said land, and completed the registration of ownership transfer with respect to the above F land on the same day.
E On July 14, 1997, after obtaining a building permit under its name and completing the construction work of D building through the construction work, etc., and completed the roof slabing construction on February 27, 200.
E completed the registration of ownership transfer on October 25, 200 with respect to the land of this case on the ground of the reversion of trust property to the Defendant, and the Defendant completed the registration of ownership transfer on October 26, 200 again on the ground of trust to E.
On October 28, 200, the defendant changed the owner of the new construction of D building from E to the defendant on November 6, 2000, entered into a trust contract with respect to each partitioned building of E and D (hereinafter referred to as "each partitioned building") on November 7, 2000, and completed registration of preservation of ownership in its name with respect to each partitioned building on November 16, 200.
D The second or third above ground level of the building was registered by dividing into at least 100 stores (old units) per each floor, and the defendant completed the registration of ownership transfer on November 21, 2000 with respect to each partitioned building E.
The transfer E and the defendant sold part of the D building scheduled to be newly built from August 1997 to June 199.
