1. The Defendant’s KRW 66,954,538 and its annual rate from February 19, 201 to June 15, 2012 to the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff is a party’s position 1) The Plaintiff is Jongno-gu Seoul Metropolitan Government 2,17.4 square meters, B 178.2 square meters, and C 458.2 square meters (hereinafter “instant land”).
2) The Defendant held each of the sectional sections listed in the separate sheet (hereinafter referred to as “each of the instant sectional sections,” and the title of the owner in the separate sheet in the separate sheet in the attached sheet (hereinafter referred to as “instant building”) among the 7th underground floors and the 15th floor buildings (hereinafter referred to as “instant building”) constructed on the instant land during the period of entry in the “period of possession” in the attached sheet.
B. New Entertainment Co., Ltd., which was the original owner of the instant land (formerly changed trade name: Namyang Tourism Co., Ltd.; hereinafter “FID”) was the initial owner of the instant land
(2) After the completion of the building of this case, the registration of ownership transfer was completed on November 16, 200 in the name of Jongno-gu Seoul on December 24, 1996 on the ground of the above trust contract, and on October 22, 1997 on the land of this case, the registration of ownership transfer was completed in the name of Jongno-gu Seoul on the land of this case on the ground of the above trust contract.
3) On November 21, 2000, the Defendant completed the registration of transfer of ownership in the name of the Defendant on the ground of a trust agreement as of November 7, 2000 with respect to each of the sectional sections of the instant building, and concluded three multilateral contracts for sale among the Defendant, Bazn Investment, and buyer with respect to each sectional unit with the invitation of buyers. Article 5 of the above sales contract provides for the right to use the instant land as follows, and Article 2 of the sales contract provides for the right to use the instant land, and the amount of sale in the sectional section as provided for in Article 2 of the sales contract is the amount equivalent to about 61% of the sales price of the instant sectional building.
