Punishment of the crime

"2016 Highest 283" is the owner of "F" of the multi-family house E in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Incheon (hereinafter referred to as "the main building"), and the defendant has been delegated by D from March 2013 to manage and lease the main building.

Around June 2014, the Defendant and D posted an advertisement of 304 units of this building on the website of “G” to set the deposit of 80 million won, and the said advertisement requested H to provide information on the current status of the lease of this building.

Of the total 19 households, 14 households are 14 households, 5 households are 761,00,000 won, the total amount of deposit is 624,00,000 won, and the maximum amount of maximum debt was set up.

On the other hand, D thought that it is difficult to establish a lease contract for No. 304 of the building in this case if it is true that the present condition of the building in this case is true, D would give the Defendant an instruction that “I will change the lease contract as soon as present financial conditions are low, and if there is a time later, it will be changed as monthly,” and accordingly, the Defendant prepared a false “F Lease” with the content of the lease status of the building in this case “three generation, three generations in the factory room, three generations in the 19th generation, three generations in the 13th generation, three generations in the month, and the total deposit amount of KRW 240,000,00 among the total 19 households,” and then conspired to enter into a lease contract with H by falsely notifying the present condition of the building in this case.

Accordingly, around July 4, 2014, the Defendant and D presented the “F Lease Details” prepared falsely to the victim K, as seen above, at the “J Licensed Real Estate Agent Office” in the operation of H located in Seo-gu, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, and H, who knows that the “F Lease Details” was false, and “the maximum debt amount is 624,000,000,000 the building of this case.” Even if the building was sold at auction, the auction is one billion won, and thus, the right to collateral security established on the building of this case.
