1. The Defendant’s KRW 75,126,027 as well as 5% per annum from February 11, 2017 to April 20, 2017 to the Plaintiff.
Reasons
1. Basic facts
A. “D” (hereinafter “instant building”) in Seoan-gu, Seoan-gu, Seoan-gu, Seoan-gu, Seoul is owned by E, while operating “F,” the Defendant has been delegated by E from March 2013 to manage the facilities, leases, etc. of the instant building.
B. Around June 2014, Defendant and E posted an advertisement on the F’s website that the instant building 304 units of KRW 80,000,000,000 was placed. Around June 2014, the Defendant and E requested the said advertisement to furnish information on the current status of the lease of the instant building by the licensed real estate agent G.
C. Of the total 19 households, 14 households, 14 households, 5 households, 761,00,000 won in total, and 624,000,000 won in total, and 624,000,000 won in total, were established. If the present condition of the instant building is true, E thought that it would be difficult to establish a pre-sale contract for the said building (304) and ordered the Defendant to conclude a contract with the lower rate of the pre-sale rate of the building, and later, it would be changed as monthly if there is a later time. Accordingly, the Defendant: (a) on the current status of the instant building, “D lease” was prepared and issued to G, with the content that “the 19 households, 3 households, 3 households, monthly households, 13 households, total deposit money, 240,000,000 won in total,” and (b) notified the present status of the instant building by false means.
Accordingly, around July 4, 2014, the Defendant and E presented “D Lease Details” in the “I Licensed Real Estate Agent Office” for the operation of H located in Seo-gu, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, and “D Lease Contents” to the Plaintiff, who knows that the “D Lease Contents” was false, as seen above, and the mortgage (the maximum debt amount is 624,000,000,000) is established on the instant building. Even if the said building was sold at auction, the auction is one billion won, and thus, the said building is 480,000,000 won, excluding the maximum debt amount of the right to collateral security established on the said building.
